Terms and Conditions
Wild Lands Africa (sole proprietor) shall not be liable for any loss, damage or expense of any nature whatsoever suffered by the client of any traveller or delegate arising from:
• the cancellation or curtailment of any tour (subject to accommodations selected refunds policy)
• the loss or any damage to any property.
• sickness, quarantine, weather conditions, war, strikes, riots and/or any other cause of any nature whatsoever, however caused .
No refund or credit will be granted for travellers that:
• Fail to join a tour with Wild Lands Africa and have booked.
• Join the tour after departure date with Wild Lands Africa.
• Leave the tour prior to completion date.
Cancellation of / or change of a guest during quote stages will require a new quote to be issued.
Wild Lands Africa accepts no liability for the death of, or injury to, loss and/or damage to, any person and/or property arising out of any act or omission of with Wild Lands Africa.
The client and the traveller/delegate shall be deemed to have waived, renounced and abandoned any and all rights and entitlements to which the client and the traveller/delegate may be entitled under the provisions of the law of the Republic of South Africa for any loss or damage to person and/or property.
Should sickness or accident interrupt a tour or conference, or accommodation, with Wild Lands Africa shall not be liable for any:
• loss, damage or expense arising there from your negligence or otherwise.
• refund, either total or partial, of money paid with Wild Lands Africa. Its recommend that the necessary insurance put in place to protect against any such eventuality.
Travellers/delegates may not carry any unlawful firearms, articles or substances whilst travelling with Wild Lands Africa whether on a tour or a transfer. Any traveller/delegate who contravenes the aforesaid prohibitions, with Wild Lands Africa will be entitled to immediately exclude the offender from the tour/conference/accommodation and such traveller/delegate will be responsible for his or her own repatriation and all costs associated therewith. Wild Lands Africa will under no circumstance assist with any dealings or negotiations with any authority.
Travellers/delegates shall be solely responsible for complying with the formalities required by police, customs, health and all other authorities at the point of departure, at the destination and whilst in transit. Whilst with Wild Lands Africa will endeavour to provide the client, prior to departure, with the latest information concerning such regulations and restrictions with Wild Lands Africa shall not be responsible and does not accept any liability for any inaccuracies or omissions in this regard.
Wild Lands Africa reserves the right to decline to accept or retain any traveller on any tour or transfer at any time as the result of the non-payment of any amount due by the client in respect of such traveller/delegate or if such traveller/delegate interferes with any other member of any group and/or causes any disturbance or nuisance.
Should Wild Lands Africa appoint a tour leader or tourist guide in respect of any tour or transfer, the traveller must accept all reasonable instructions of such tour leader or tourist guide.
All information contained in with Wild Lands Africa brochures web sites/itineraries and price inserts are to the best of with Wild Lands Africa knowledge and belief, true and correct, but with Wild Lands Africa accepts no liability for any inaccuracies contained therein.
All travel arrangements made with Wild Lands Africa are subject to the booking conditions and cancellation provisions of the supplier thereof.
Wild Lands Africa reserves the right to alter or substitute routes, tours, accommodation, venues, refreshments, meals, itineraries, services, vehicles and/or arrangement should conditions necessitate.
Wild Lands Africa accepts no responsibility for any injury, damage, loss, accident, delay, irregularity and/or inconvenience which may be occasioned by any defect in any object (including a vehicle) utilized by any supplier for the supply of any service or by an act or omission of any supplier or its servants or agents.
The Undersigned acknowledges that engaging in this activity may require a degree of skill and knowledge and that the undersigned has responsibilities as a participant.
The Undersigned certify that the participant is fully physically, mentally and emotionally capable of participating in this Safari or Activity.
The Undersigned declare that the participant is in good health and physically fit and has not been advised by a physician not to participate in arduous physical activities. The Undersigned knows of no reason, health-related or otherwise, why the person is not capable of participating in the activities planned for this excursion.
The Undersigned accept full responsibility for any injuries or illnesses that the applicant may suffer during the trips, including, but not limited to, those resulting from any pre-existing medical condition.
The Undersigned fully understand and appreciate the risk of injury, illness, property loss or theft, and even death inherent in the Activity. It is further understood that unforeseen circumstances may arise and Wild Lands Africa shall not be held responsible for such circumstances or the consequences thereof.
The Undersigned will undertake to provide all necessary clothing and equipment. The Undersigned accept full responsibility for inadequate clothing or equipment and for clothing and equipment which they fail to provide.
Certain hazards and risks are inherent in each Safari / activity and cannot be eliminated without destroying the unique character of such activities. These inherent risks are some of the same elements that contribute to the unique character of the hazards and risks are inherent in each Safari / activity but can be the cause of destruction, loss or damage to equipment or other personal property, or personal injury, illness, suffering, or in extreme cases, permanent trauma or death.
Wild Lands Africa does not want to concern the participant or reduce the participant’s enthusiasm for this activity, but believe it is important for the undersigned to know in advance what to expect and to be informed of the inherent risks.
The Safari / activity may take place in a wild environment and may include: Big 5 plus other dangerous animals, Safari drives or Big 5 walks, walking, backpacking, swimming in lakes/ sea, dams and rivers, canoeing & kayaking on lakes, river and dams, (extreme sports) fire-building, cooking over a fire or camp stove, camping in tents in remote areas including developed and undeveloped campgrounds in rural, outside under the stars and wilderness areas. The Safari/activity may also include transportation with various aircraft, various vehicles, open game viewing vehicles or open motorized and non-motorized boats.
In addition to the hazards and risks, weather conditions (including unforeseen, inclement or intemperate weather), acts of God such as falling trees and natural disasters, consumption of food and drink, fire, first aid, emergency treatment, or other services rendered.
The Undersigned acknowledge the risk of animals, insects and pests such as, but not limited to, mosquitoes and tsetse flies and the possible associated illnesses and diseases.
The Undersigned also acknowledges and agrees that failure to follow the directions of Shane Bennitt of Wild Lands Africa guides and/or its nominated employees or contractors, and/or failure to obey the laws of any visiting country, or for a participant to behave in an incompatible, conflicting, or a discordant manner, may result in a participant’s removal from a safari/ activity and them being sent home at the Undersigned’s expense.
Furthermore, the Company will not always have medical personnel (other than basic first aid qualified guides) at the location of its activities.
The Undersigned acknowledge that the leading guide/s of Wild Lands Africa whilst on safari/ activity have the final authority on how a safari/activity proceeds and operates from day to day. The undersigned also acknowledge that the lead guide/s have been available to more fully explain the nature and physical demands of this Safari/ activity and the inherent risks, hazards and dangers associated with this activity.
NOW THEREFORE, IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THIS SAFARI/ACTIVITY , THE UNDERSIGNED ASSUMES ALL RISKS AND ACCEPTS FULL RESPONSIBILITY SURROUNDING THE PARTICIPANT’S PARTICIPATION IN THE ACTIVITIES, THE TRANSPORTATION RELATED TO THE TRIP AND ANY ACTIVITIES UNDERTAKEN AS AN ADJUNCT THERETO, WHICH RISKS AND RESPONSIBILITY INCLUDE FOR BODILY INJURY, DEATH OR LOSS OF OR DAMAGE TO PERSONAL PROPERTY AND EXPENSES AS A RESULT OF THOSE INHERENT RISKS AND DANGERS IDENTIFIED HEREIN AND THOSE INHERENT RISKS AND DANGERS NOT SPECIFICALLY IDENTIFIED, OR AS A RESULT OF THE STUDENT’S NEGLIGENCE IN PARTICIPATING IN THIS SAFARI/ ACTIVITY, AND THE UNDERSIGNED HEREBY WAIVES, RELEASES AND AGREES TO INDEMNIFY AND SAVE HARMLESS THE COMPANIES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS OF AND FROM ANY AND ALL LIABILITY ARISING THEREFROM, EXCEPT SUCH AS SHALL ARISE FROM ITS OR THEIR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
The Undersigned have carefully read, clearly understands and accept the terms and conditions stated herein and acknowledge, that this Participant’s Acknowledgment of Risks shall be effective and binding upon each of the Undersigned, or respective heirs, assigns, personal representatives, estates and for all members of the student’s family.
The authorization shall remain effective until revoked in writing.
Prices are also subject to adjustment in the event of changes in government imposed taxes, fuel prices, air fares, hotel charges, tourism levies and/or the introduction of national, regional or local taxes or levies of whatever nature.
Quotations are valid only to the expiry date stated on the quotation and are subject to adjustment if the services quoted for are not available at the time of booking. Quotations are based on itineraries and requirements specified by the customer. Upon acceptance of the quotation, any changes requested by the customer which incur additional costs m Wild Lands Africa Terms and Conditions of Business.
Payment shall be made in all instances (by account holders and non-account holders) in the currency in which the quotation was accepted or in which the invoice is made out. All payments shall be made to SG Bennitt t/a WildLands Africa. Bank charges are the responsibility of the transferor.
Payment in approved foreign currency will be accepted at the rate of exchange applied by the bankers of with Wild Lands Africa at the time of receipt of payment. Any shortfall resulting from exchange rate fluctuations will be for the account of the client.
